REGULATIONS OF THE SHOECRATES ONLINE STORE

THESE REGULATIONS DETERMINE THE MANNER OF OPERATION OF THE ONLINE STORE NAMED SHOECRATES LOCATED AT THE WEBSITE ADDRESS SHOECRATES.COM AND THE CONDITIONS OF USE. THE REGULATIONS SPECIFY THE RIGHTS AND OBLIGATIONS OF REGISTERED CLIENTS OF THE STORE, AS WELL AS THE RIGHTS, OBLIGATIONS AND SCOPE OF LIABILITY OF THE ADMINISTRATOR AS THE ENTITY MANAGING AND OPERATING THE STORE.

AFTER REGISTERING, EVERY POTENTIAL CUSTOMER IS REQUIRED TO READ THE CONTENT OF THE REGULATIONS AND MAY UNDERTAKE FURTHER ACTIONS ONLY AFTER HAVING PREVIOUS CONSENT AND ACCEPTANCE OF ALL THEIR PROVISIONS.

I. GENERAL PROVISIONS.

THE PROVISIONS OF THESE REGULATIONS (hereinafter referred to as the "REGULATIONS") APPLY TO ALL AGREEMENTS CONCLUDED WITH SHOECRATES FOR THE SALE AND DELIVERY OF GOODS THROUGH THE SHOECRATES.COM ONLINE STORE (hereinafter referred to as the "STORE"), REGARDLESS OF THE MEANS OF AGREEMENT APPLIED IN A GIVEN CASE. DISTANCE CONTACT USING FOR CONTACT OR CONCLUDING CONTRACTS BETWEEN CONSUMERS AND ENTERPRISES WITHOUT THE PHYSICAL PRESENCE OF THE PARTIES TO THE CONTRACT.
THE REGULATIONS ARE ADDED TO ALL REGISTERED AND UNREGISTERED USERS OF THE STORE (hereinafter referred to as "CUSTOMER") AND SPECIFY THE RULES FOR REGISTRATION AND USE OF THE STORE ACCOUNT, RULES FOR MAKING ELECTRONIC RESERVATIONS OF PRODUCTS AVAILABLE IN THE STORE'S OFFER, PLACING ORDERS IN THE STORE AND RULES FOR CONCLUDING SALES AGREEMENTS.
A NECESSARY CONDITION FOR STARTING TO USE THE STORE AND PLACING ORDERS IS THAT YOU READ THESE REGULATIONS AND ACCEPTED THEM.
THE CUSTOMER MAY PLACE AN ORDER WITHOUT THE NECESSITY TO PERMANENTLY REGISTER THEIR DATA IN THE STORE'S DATABASE, PROVIDED THAT THE CUSTOMER HAS READ AND ACCEPTED THE PROVISIONS OF THESE REGULATIONS.


II. ORDER.

THE STORE SELLS GOODS ONLY VIA THE INTERNET.
THE STORE ACCEPTS ORDERS PLACED ONLINE 24 hours a day, every day of the week. ORDERS ARE ACCEPTED ON SHOECRATES.COM.
IN ORDER TO PLACE AN ORDER, YOU SHOULD SELECT PRODUCTS FROM THE STORE'S AVAILABLE OFFER, SIZES AND QUANTITIES BY "ADDING" THEM TO THE CART.
ALL PRICES ARE IN PLN AND INCLUDE VAT. THE PRICE GIVEN FOR EACH GOODS IS BINDING FROM THE MOMENT THE CUSTOMER PLACES THE ORDER (AND CONFIRMATION) AND DOES NOT CHANGE EVEN IF THE PRICES OF THE PRODUCTS IN THE STORE INCREASE.
UNTIL THE SELECTION OF THE ORDERED PRODUCTS IS CONFIRMED BY USING THE "GO TO CHECKOUT" BUTTON, THE CUSTOMER HAS THE POSSIBILITY TO MAKE CHANGES AND MODIFICATIONS TO THE PRODUCTS IN THE ORDER.
AFTER APPROVING THE ORDERED PRODUCTS, THE CUSTOMER IS REQUIRED TO PROVIDE HIS CONTACT DETAILS (APPLICABLE TO NON-REGISTERED CUSTOMERS), DELIVERY METHOD AND PAYMENT METHOD.
SHIPPING COSTS MAY BE ADDED TO YOUR ORDER, WHICH WILL BE DECIDED WHEN PLACING THE ORDER.
SENDING THE ORDER BY THE CUSTOMER (APPROVAL BY THE "PLACE ORDER" BUTTON) CONSTITUTES THE CUSTOMER'S OFFER TO CONCLUDE A SALES AGREEMENT IN ACCORDANCE WITH THE REGULATIONS. IN THE CASE OF CLIENTS NOT REGISTERED TO PLACE AN ORDER, IT IS NECESSARY TO READ AND ACCEPT THE REGULATIONS PRIORLY.
THE STORE ACCEPTS THE FOLLOWING FORMS OF PAYMENT: BANK TRANSFER, PAYMENT VIA PAYPAL AND PAYPAL PAYMENT SYSTEMS.
AFTER PLACING THE ORDER, THE CUSTOMER RECEIVES BY E-MAIL INFORMATION ON ITS ACCEPTANCE, WHICH CONSTITUTES CONFIRMATION OF THE CONCLUSION OF THE SALES AGREEMENT.
IN THE CASE OF PAYMENT BY BANK TRANSFER, THE FUNDS MUST RECEIVE THE STORE'S BANK ACCOUNT WITHIN 5 DAYS FROM THE DATE OF ORDER CONFIRMATION, OTHERWISE THE ORDER WILL BE CANCELED. THE CUSTOMER WILL BE INFORMED BY E-MAIL ABOUT CANCELLATION OF THE ORDER.
ORDER PROCESSING STARTS ON THE NEXT BUSINESS DAY AFTER THE PAYMENT REGARDING THE ORDER IS RECEIVED IN THE STORE'S BANK ACCOUNT OR ON THE NEXT BUSINESS DAY AFTER CONFIRMATION OF THE ORDER IN THE CASE OF PAYMENT VIA PAYPAL OR PAYMENT SYSTEMS. PAL.
THE STORE RESERVES THE RIGHT TO REFUSE TO PROCESS QUESTIONABLE ORDERS, I.E. WHICH ARE MISSING A PHONE NUMBER OR EMAIL ADDRESS. THEY ARE NECESSARY TO CONFIRM THE ORDER. THE INFORMATION CONTAINED IN THE FORM SHOULD BE TRUE, CURRENT AND ACCURATE. THE STORE RESERVES THE RIGHT TO REFUSE TO PROCESS AN ORDER IF THE DATA PROVIDED IS OF SUCH A TYPE THAT, ASSESSING THE CASE, IT CAN REASONABLY ASSUME THAT THE DATA ARE FALSE OR WERE PROVIDED FOR A JOKE, AS WELL AS WHEN THEY ARE SO INACCURATE THAT THEY MAKE IT IMPOSSIBLE TO COMPLETE THE ORDER, IN PARTICULAR THEY MAKE IT POSSIBLE TO PROPER DELIVERY OF THE SHIPMENT. BEFORE REFUSING TO PROCESS, THE STORE WILL ATTEMPT TO CONTACT THE CUSTOMER IN ORDER TO DETERMINE DATA TO THE EXTENT THAT ALLOWS THE ORDER TO BE COMPLETED. IF YOU CHOOSE TO PAY VIA PAYPAL, THE STORE WILL ONLY SEND THE GOODS TO THE "CONFIRMED PAYPAL ADDRESS".

III. EXECUTION OF THE CONTRACT.

THE GOODS ARE DELIVERED IN THE WAY SELECTED BY THE CUSTOMER AND SPECIFIED IN THE ORDER.
THE STORE IS OBLIGED TO DELIVER THE PARTICIPATION TO THE BUYER WITHIN A MAXIMUM OF 30 DAYS FROM THE DATE OF ORDER CONFIRMATION. IF THE SELLER DOES NOT DELIVER THE ORDER TO THE CUSTOMER WITHIN THIS DATE, REGARDLESS OF THE REASONS FOR NOT DELIVERING THE SHIPMENT ON TIME, THE CUSTOMER HAS THE RIGHT TO WITHDRAW FROM THE AGREEMENT. AFTER RECEIVING INFORMATION FROM THE CUSTOMER ABOUT WITHDRAWAL FROM THE CONTRACT, THE STORE HAS 14 DAYS TO REFUND THE AMOUNT PAID BY THE CUSTOMER.
IN THE EVENT OF UNAVAILABILITY OF PART OF THE GOODS COVERED BY THE ORDER, THE CUSTOMER WILL BE IMMEDIATELY INFORMED ABOUT THE STATUS OF THE ORDER AND MAKE A DECISION ON THE METHOD OF ITS PROCESSING (PARTIAL IMPLEMENTATION, EXTENSION OF WAITING TIME, CANCELLATION OF THE ENTIRE ORDER).
IF CIRCUMSTANCES OCCUR THAT MAKE IT IMPOSSIBLE TO COMPLETE AN ORDER, THE STORE RESERVES THE RIGHT TO SUSPEND ITS PROCESSING, AND WILL IMMEDIATELY NOTIFY THE CUSTOMER OF ANY SITUATION THAT OCCURRED.
IF THE CUSTOMER DECIDES TO CANCEL THE ORDER AND HAS HAD PREVIOUSLY PAID, THEN THE AUTOMATIC REFUND OF THIS AMOUNT TOGETHER WITH THE SHIPPING COSTS WILL BE DONE WITHIN 14 DAYS AFTER THE STORE RECEIVES AN E-MAIL INFORMING OF THE CANCELLATION BY THE CUSTOMER. A PLACED ORDER. HOWEVER, IN THE CASE OF THE CUSTOMER'S DECISION REGARDING PARTIAL EXECUTION OF THE ORDER, THE PREVIOUSLY PAID AMOUNT WILL BE CREDITED TOWARDS THE PAYMENT FOR THE PARTLY COMPLETED ORDER AND THE REMAINING SURPLUS WILL BE AUTOMATICALLY REFUNDED WITHIN 14 DAYS AFTER THE STORE RECEIVES AN E-MAIL INFORMING ABOUT PARTIAL COMPLETION OF THE ORDER.


IV. PERSONAL DATA PROTECTION.

THE CONTROLLER OF THE PERSONAL DATA OF THE STORE'S CLIENTS WITHIN THE MEANING OF THE ACT OF AUGUST 29, 1997 ON THE PROTECTION OF PERSONAL DATA (Journal of Laws of 1997, No. 133, item 883, as amended) IS JACEK JAKLEWICZ INVESTMENTS WITH ITS REGISTERED OFFICE IN KIELCE AT UL. DUŻEJ 17/ 3
PROVIDING PERSONAL DATA BY THE CUSTOMER IS VOLUNTARY, BUT NECESSARY TO COMPLETE: REGISTRATION OF AN ACCOUNT, PURCHASE OF GOODS, FILLING IN THE ORDER FORM.
THE CUSTOMER MAY CONSENT TO THE PROCESSING OF HIS PERSONAL DATA FOR MARKETING PURPOSES BY THE STORE.
THE CUSTOMER HAS THE RIGHT TO ACCESS THE CONTENT OF HIS DATA, CORRECT THEM AND REQUEST DELETION.


V. FINAL PROVISIONS.

THE COURT WITH LOCAL COMPETENCE TO RESOLUTE DISPUTES IS THE COURT WITH LOCAL COMPETENCE IN ACCORDANCE WITH APPLICABLE REGULATIONS.
POLISH LAW APPlies TO THE AGREEMENT FOR THE SALE OF PRODUCTS IN THE STORE. THE AGREEMENT IS CONCLUDED IN POLISH.
IN ACCORDANCE WITH THE ACT OF AUGUST 29, 1997 (Journal of Laws of 1997, No. 133, PO. 833) ON PERSONAL DATA PROTECTION, WE INFORM YOU THAT CUSTOMER PERSONAL DATA ARE STORED IN OUR COMPANY'S DATA FILE. PERSONAL DATA IS COLLECTED EXCLUSIVELY FOR OUR NEEDS AND PROCESSED FOR THE PURPOSE OF IMPLEMENTING THE COMPANY'S STATUTORY BUSINESS ACTIVITIES, CONDUCTING PROMOTIONAL AND ADVERTISING CAMPAIGNS WHILE MAINTAINING THE DATA SECURITY REQUIREMENTS SPECIFIED IN THE PERSONAL DATA PROTECTION REGULATIONS.
THE ADMINISTRATOR RESERVES THE RIGHT TO CHANGE THE PROVISIONS OF THESE REGULATIONS IN PARTICULARLY JUSTIFIED CASES, INCLUDING:
A) IN ORDER TO ADAPT THEM TO COMMONLY APPLICABLE LAW,
B) IN ORDER TO ELIMINATE POSSIBLE PROVISIONS THAT MAY VIOLATE CUSTOMER INTERESTS,
C) IN CONNECTION WITH THE CHANGE OR EXTENSION OF THE OFFER OF SERVICES AND GOODS PROVIDED BY THE STORE,
D) DUE TO THE CHANGE OF THE BUSINESS PROFILE.
CHANGES REFERRED TO IN SECTION 4 ARE NOT BINDING ON CUSTOMERS WHO HAVE PLACED AN ORDER BEFORE THE CHANGES IN THE FOLLOWING TERMS AND CONDITIONS ARE INTRODUCED, UNLESS THE CHANGES RESULT FROM ABSOLUTELY APPLICABLE LAW. THE CUSTOMER WILL BE NOTIFIED OF ANY CHANGE TO THE REGULATIONS TO THE E-MAIL ADDRESS PROVIDED WHEN PLACING THE ORDER.
IF CHANGES ARE MADE IN THE REGULATIONS, THE STORE WILL IMMEDIATELY INFORM CUSTOMERS ABOUT THEM BY PUBLISHING THE UNIFORM TEXT OF THE REGULATIONS ON THE SHOECRATES.COM WEBSITE AND BY NOTIFICATION SENT TO THE EMAIL ADDRESS PROVIDED BY THE CUSTOMER. THE CUSTOMER (APPLY TO REGISTERED CUSTOMER) MUST ACCEPT THE CHANGES IF HE WANTS TO CONTINUE TO USE THE STORE'S SERVICES.
THE REGULATIONS ENTER INTO EFFECT ON May 25, 2018.
